KCSIE 2024 says “Copies of DBS certificates and records of criminal information disclosed by the candidate are covered by UK GDPR / DPA 2018 Article 10.” The DfE also says that people who process criminal record data should understand their responsibilities as set out in the Rehabilitation of Offenders Act (ROA) 1974. The legislation around managing and processing criminal data is complex – in addition to the ROA1974, schools are also bound by the Exceptions Order 1975 (as amended in 2013, 2020 and 2023) , the Police Act 1997 and the DBS Code of Practice.
This webinar is relevant to anyone who sees, or may see, criminal information during the recruitment process; for example, on a DBS certificate, criminal / suitability self-declaration or as a result of an online search on shortlisted candidates.
